General Terms and Conditions

 

1.1 The mention of JADE Safety and Security B.V. in this document refers to JADE Safety and Security B.V. registered with the Chamber of Commerce in Utrecht under Chamber of Commerce number: 16039021

1.2 These General Terms and Conditions apply exclusively to all legal relationships in which JADE Safety and Security B.V. acts as supplier of products.

1.3 JADE Safety and Security B.V. accepts no reservations in orders from the counterparty (hereinafter referred to as: the customer).

1.4 JADE Safety and Security B.V. reserves the right to change these terms and conditions at any time. The customer acknowledges that JADE Safety and Security B.V. is authorized to amend these General Terms and Conditions and agrees to be bound by the thus amended General Terms and Conditions. In case of a substantive change to the General Terms and Conditions, JADE Safety and Security B.V. will notify all users by email and send the amended General Terms and Conditions.

2. Payment

2.1 Payment can be made via Ideal / Credit Card / Paypal account / Klarna or bank transfer.

2.2 Purchase on account is possible by arrangement.
 
JADE Safety and Security B.V. is furthermore entitled, in addition to the principal and interest, to claim from the customer all costs, both judicial and extrajudicial, caused by the missed payment, including the costs of lawyer, attorney, agent, bailiff, and collection agency. For putting the customer in default, JADE Safety and Security B.V. is entitled to charge the actual costs, increased by a reasonable amount for office expenses.

3. Prices

3.1 All prices stated on the website www.jadesafety.com are subject to typographical errors.

3.2 All prices stated on the website www.jadesafety.com  are stated including and excluding VAT.

3.3 All prices listed on the product page on this website www.jadesafety.com are exclusive of shipping costs.

3.4 An offer from JADE Safety and Security is deemed to be made without obligation, unless expressly agreed otherwise in writing. Offers are made subject to product availability. JADE Safety and Security has the right to dissolve the agreement.

3.5 Although JADE Safety and Security will exercise due care in formulating its offers, including price lists and other data that may indicate any (upcoming) legal relationship between the provider and the customer, the customer can never derive any justified reliance on the accuracy of the data included herein, unless expressly agreed otherwise in writing. All images, drawings, data concerning weights, dimensions, colors, etc. are only approximate. Deviations from reality cannot give rise to compensation and/or dissolution.

4. Delivery

4.1 Delivery only within the Netherlands. Delivery abroad by consultation.

4.2 JADE Safety and Security B.V. cannot guarantee the availability of all products. In case of a shortage, the customer will be informed and the transferred amount will be refunded.

4.3 JADE Safety and Security B.V. will initiate delivery within 5 working days but is also entitled to fulfill the delivery in parts. The additional costs of the subsequent delivery are borne by JADE Safety and Security B.V.

4.5 Delivery is only made to persons aged 16 years or older.

5. Liability

5.1 JADE Safety and Security B.V. is not liable for damage caused by the purchase and/or use of delivered products.

5.2 JADE Safety and Security B.V. is not liable for damage caused during the shipping of delivered products.

5.3 The period mentioned in 4.3 is indicative and not a strict deadline. JADE Safety and Security B.V. is never liable for damages resulting from exceeding this delivery time.

6. Exchanges / returns

6.1 Exchanging without giving a reason is possible if the delivered product is in its original condition and the delivered product is back in the possession of JADE Safety and Security within 10 working days after delivery.

6.1.1 Costs arising from the desired exchange mentioned above (for example shipping costs) are borne by the customer.

6.4 Returns are possible when the product is in its original condition and the delivered product is back in the possession of JADE Safety & Security within 10 working days after delivery; the purchase amount of the product will then be refunded to you within a few days.

6.4.1 Costs arising from the desired exchange mentioned above (for example, shipping costs) will be borne by the customer.

6.5 Damaged delivery: If the delivery is damaged upon arrival, we ask you to contact us about this at 030-2271000 or email sales@jade-bv.nl
We will probably ask you to take a photo of the product and send it to us; our employee will provide you with a return number to which you can return the product free of charge.
In consultation, we will send you a new product.
We apologize in advance for the inconvenience. 

7. Shipping costs

7.1 JADE Safety and Security charges shipping costs per order. The costs depend on the type and number of products and can be found on this website.

8. Complaints (warranty)

8.1 The customer is obliged to thoroughly inspect the delivered goods for defects immediately after delivery and, if any are present, to notify JADE Safety and Security in writing without delay. If the customer does not notify JADE Safety and Security of defects that could have been detected upon thorough inspection within five days after the day of delivery, the customer is deemed to agree with the condition in which the goods were delivered and any right to complain lapses.

9. Compensation for damages

9.1 JADE Safety and Security can only be held liable for damage that is attributable to its intent or gross negligence, or that arises from circumstances that, according to mandatory legal rules, are at its risk, and in such cases its liability will never exceed the value of the sales price.

9.2 Circumstances that are in any case not at the risk of JADE Safety and Security are: strikes, lockouts, illness, import, export and/or transit bans, transport problems, failure of suppliers to meet obligations, production disruptions, etc.

10. Canceling orders

10.1 Free cancellation of an order confirmed by us is only possible within 24 hours.

10.2 If the period mentioned in 4.3 is exceeded by more than two weeks, the customer has the option to cancel the order free of charge. However, the customer must always indicate in writing that the order must be canceled.

Information gathering and use JADE Safety and Security is the sole owner of the information collected through this site. We do not sell, share, or rent this information to others. However, we do collect user information at various places in our webshop

Registration To order items or receive the newsletter, the user must provide JADE Safety and Security with personal information such as email address, date of birth, or gender. This information is only used to actually deliver the items or send the desired newsletter.

Warranty

We offer a 10-year warranty on manufacturing defects for our house brand (PRIMA / Dorrenhaus / Keyi) door closers.
The following cases fall under manufacturing defects.
- cracks in metal
- seizure of the internal mechanism
- breaking of the door closer shaft
- seizure of the bearings.

Oil leakage is not normally covered under the warranty terms.
If you have an oil leak, we ask you to contact us.
Our technical service will then determine whether this is covered by the warranty.
